Terms and Conditions
Draft for legal review. Not yet in effect.
Last updated: October 23, 2026. Version: 2026-10-draft-5.
These Terms and Conditions ("Terms") are an agreement between you and Pursiva LLC ("Pursiva", "we", "us"), a Florida limited liability company with its address at 5761 Groundsel Cir, Sarasota, FL 34238. They cover the Pursiva app, the website at pursivaprep.com and everything we provide through them (together, the "Service").
Please read them carefully. By creating an account and ticking the box that says you agree, you accept these Terms and our Privacy Policy. You agree to the automatic renewal of your membership separately, in a box of its own. If you do not agree, please do not use the Service.
1. Who can use Pursiva
The account holder must be an adult. A Pursiva account is created by, and belongs to, a parent or legal guardian of the student, or by a student who is 18 or older. In these Terms, "you" means that account holder.
The student must be at least 13. Pursiva is built for high school students. We do not knowingly collect information about anyone under 13. If we learn that a student is under 13, we will suspend the account within 24 hours, delete the information within 7 days and refund the current month.
One account per student. Each membership covers one student. When a parent or guardian is the account holder, they give the student permission to use the account, and they are responsible for how the account is used, including by the student.
Accurate information. You agree to give us accurate information, to keep your sign-in details private, and to tell us at support@pursivaprep.com if you think someone has used your account without permission.
2. Your membership, renewal and cancellation
Price. Membership costs $49.90 per month, in US dollars, plus any sales tax or VAT that applies where you live. The price you pay, including any tax and in your currency where shown, appears before you pay.
Who sells the membership. Your membership is sold through Link, Stripe's checkout service, which acts as the reseller for the payment (the "merchant of record") under Link's terms. Link's name appears on your receipts, and your card statement shows LINK.COM* PURSIVA. Pursiva provides the Service and remains responsible for it, including these Terms, the automatic renewal and how you cancel.
Automatic renewal. Your membership renews automatically every month, on the same day of the month you subscribed, and the payment method you chose at checkout is charged each time, until you cancel.
How to cancel. You can cancel at any time, online, in Account → Manage billing. You do not need to contact us. Cancelling stops all future charges. Your access continues until the end of the month you have already paid for, and then your membership ends.
No refunds for partial months. Payments are not refundable and we do not give credits for unused parts of a month, except where the law requires it.
If you live in the European Union, the United Kingdom or Switzerland. You can cancel within 14 days of first subscribing and get a full refund of that first payment: write to support@pursivaprep.com. This does not affect any other right the law where you live gives you.
Discounts and promotions. If you subscribe with a promotional code or at a discounted price, the discount lasts only for the period shown when you subscribe. After that, your membership renews automatically at the regular price then in effect, unless you cancel before the discount ends.
Price changes. If we change the price, we will email you between 7 and 30 days before the new price applies to you, with how to cancel. You can cancel before then if you do not want to continue.
Failed payments. If a payment fails, we will let you know and give you a short period to update your payment method. If it is not updated, your access will be paused until it is.
Payment processing. Payments are taken by Link and processed by Stripe. Pursiva never sees or stores your full card number.
3. What Pursiva is, and what it is not
Pursiva is a guidance and planning tool. It helps a student understand the college admissions process, build a plan, practice, and organize their work.
- No guarantee of results. Pursiva does not guarantee admission to any college, any scholarship or financial aid award, or any test score.
- Not a substitute for professional advice. Pursiva does not replace the student's school counselor, and it is not legal, tax, financial or medical advice.
- Estimates are estimates. Cost, net price, Student Aid Index and similar figures are estimates based on public data and the information you give us. Only a college's own financial aid offer says what your family will pay.
- Third-party information can change. College facts, deadlines, requirements and scholarship details come from public sources and may be incomplete or out of date. Always confirm them on the college's or provider's own site before you rely on them.
- Not an emergency or counseling service. Pursiva cannot respond to emergencies and does not provide mental health care. If a student is in crisis or in danger, call 911, or call or text 988 (the Suicide & Crisis Lifeline) in the US, and tell a trusted adult.
- Your decisions are yours. You and the student decide what to do with Pursiva's suggestions, and are responsible for the applications you submit.
SAT® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, Pursiva. Other college and organization names are used only to identify them.
4. AI-generated content
Pursiva uses artificial intelligence (AI) to produce much of what you see: plans, recommendations, feedback, summaries, assessments and draft messages ("AI Output"). Pages that show AI Output say so.
- AI Output can be wrong. It may be inaccurate, incomplete, out of date, or not right for your situation, even though we design it to be grounded in your own information and in the methods Pursiva follows. Please read it critically and check anything important before relying on it.
- Pursiva coaches; it does not write the student's application. Pursiva gives feedback on essays and helps the student think, but it does not write college essays for them. The student must submit their own work and follow each college's and testing organization's rules, including any rules on the use of AI.
- People are involved. AI Output is a starting point for the student and family, not a final decision.
5. Your content
What you own. You and the student keep ownership of what you each put into Pursiva: profile answers, activities, essays, documents and other material ("Your Content"). The student owns their own essays and other writing. The AI Output Pursiva produces for you is yours to use for the student's own college planning and applications.
What you let us do with it. You give Pursiva permission, for yourself and on behalf of the student, to store, copy, process and display Your Content only as needed to provide, secure and support the Service for you. That includes sending it to the service providers who work for us, such as our AI providers, under contracts that limit what they can do with it. If you are the student's parent or guardian, you confirm that you have the authority to give this permission for the student. You can withdraw it by deleting your account.
What we do not do. We do not sell Your Content or personal information. We do not use Your Content to train AI models, and our contracts with our AI providers do not allow them to use it to train theirs.
Your responsibility. Only upload content you have the right to share. Do not upload other people's sensitive information unless you have their permission.
6. Acceptable use
When you use Pursiva, you agree not to:
- break any law, or use the Service to harm anyone;
- access, or try to access, another person's account or data;
- copy, scrape, resell or redistribute the Service or its content, or access it with bots or other automated means;
- reverse engineer, decompile or interfere with the Service, its security, or its AI systems, including by trying to make the AI produce harmful content or reveal its instructions;
- upload malware, or content that infringes someone else's rights or is unlawful, harassing or abusive;
- share one membership among several students.
7. Pursiva's property
The Service, including its software, design, methods, question banks, written content and brand, belongs to Pursiva or the people who license it to us, and is protected by law. We give you a personal, non-transferable, revocable permission to use the Service for the student's own college planning while your membership is active. Nothing else in these Terms gives you rights in our property.
8. Copyright complaints
We respect copyright. If you believe something on Pursiva infringes your copyright, please follow the process on our Copyright page. We remove infringing material when properly notified, and we close the accounts of repeat infringers.
9. Other websites and services
Pursiva links to and relies on other services, such as college websites, the College Board's Bluebook app, scholarship sites and Stripe. We do not control them and are not responsible for their content, their accuracy or how they handle your information. Their own terms and privacy policies apply.
10. Suspending or closing an account
You can delete your account at any time in Account → Delete account. What happens to your information is explained in our Privacy Policy.
We may suspend or close an account if it breaks these Terms, if we must to comply with the law, or to protect students, other users or the Service. Where we reasonably can, we will tell you first and explain why. If we close an account without a breach on your part, we will refund the unused part of the current month.
11. Disclaimers
We work hard to make Pursiva accurate, safe and available, but we provide the Service "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that the Service will always be available or error-free. Some places do not allow these exclusions, so some of them may not apply to you.
12. Limits on our liability
To the fullest extent the law allows:
- Pursiva is not liable for indirect, incidental, special, consequential or punitive damages, or for lost opportunities, including admission, scholarship or financial aid decisions, even if we were told they were possible; and
- Pursiva's total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud.
13. Your responsibility to us
If someone brings a claim against Pursiva because of how you used the Service in breach of these Terms, or because of content you uploaded without the right to do so, you agree to cover Pursiva's reasonable losses and costs from that claim, to the extent the law allows.
14. Changes to these Terms
We may update these Terms from time to time. If a change is significant, we will email the account holder at least 30 days before it takes effect, and show it in the app, except for a change the law requires or one needed for security, which we will announce as soon as we can. If you keep your membership after that date, the new version applies to you. If you don't agree with it, cancel before then: you won't be charged again, and your access continues until the end of the month you have paid for.
For some changes we will also ask you to accept the new version before it applies to you: a change to how disputes are resolved (including adding arbitration or a class action waiver), a lower limit on our liability, any new fee, and any use of Your Content beyond what section 5 describes. If you don't accept, your membership ends at the end of the month you have paid for.
A new version applies only from its effective date: it never changes how an earlier charge or dispute is handled. Each version has a date and a version number, and we keep a record of which version you accepted.
Emails from us. We send emails about your account, membership and the Service, such as renewal and price notices and security alerts. These are part of the Service and can't be turned off while you have an account. We also send occasional reminders about getting started or getting more from Pursiva. Each one has an unsubscribe link, and you can turn them off in Account → Emails from Pursiva.
15. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by applicable US federal law. If you have a concern, please email us first at support@pursivaprep.com: most issues can be solved quickly that way. If we cannot resolve it informally within 30 days, either of us may bring the dispute in the state or federal courts located in Sarasota County, Florida, or in small claims court where you live if it qualifies. Nothing here takes away rights you have under the consumer protection laws of the place you live.
16. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right right away, we have not given it up. You may not transfer your account or these Terms to anyone else; we may transfer them as part of a merger, acquisition or sale of our business, and will tell you if we do. These Terms, the Privacy Policy and anything they refer to are the whole agreement between you and Pursiva about the Service.
