What to include in a notice
Please send a written notice that includes:
- your physical or electronic signature, or that of the person authorized to act for the copyright owner;
- a description of the copyrighted work you believe has been infringed;
- a description of where the material is on Pursiva, detailed enough for us to find it;
- your name, address, telephone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for them.
When we receive a complete notice, we will remove or disable access to the material and let the person who posted it know.
Counter-notice
If material you posted was removed and you believe that was a mistake, you can send our agent a counter-notice with: your signature; a description of the material and where it was before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal court for your district (or, if you are outside the US, any district where Pursiva may be found) and will accept service from the person who sent the original notice. We may restore the material in 10 to 14 business days unless the complaining party tells us they have filed a court action.
Repeat infringers
Pursiva closes the accounts of users who repeatedly infringe others' copyrights.
Sending a notice or counter-notice that you know is false can make you liable for damages. If you are not sure whether material infringes your rights, consider asking a lawyer first.
